These Terms of Use govern your access to and use of the Max Money Mart website. By using this site or submitting an application, you agree to these terms.

1. Who we are

Max Money Mart ("we," "us") operates this website as a marketing service. We are not a lender. We do not make loan or credit decisions, and we do not fund loans. When you submit an inquiry, we pass your information to third-party lenders and lending partners in our network so they can evaluate whether to offer you a title loan. We do not charge you a fee for this service.

2. Eligibility

You must be at least 18 years old, a resident of the United States, and legally able to enter into a binding contract to use this site. You'll also need a vehicle you own (or have significant equity in) to be considered for a title loan. By submitting an application, you represent that you meet these requirements and that everything you've told us is true and accurate.

3. No guarantee of approval

Submitting an application through this site is a request to be matched with a lender, not an offer of credit and not a guarantee of one. Whether you're approved, which lender you're matched with, your vehicle's valuation, and the terms you're offered are all decided independently by the lender — we have no role in that decision and can't influence, expedite, or guarantee its outcome.

4. Acceptable use

You agree not to:

  • Submit false, misleading, or another person's information without their authorization
  • Use the site for any unlawful purpose or in violation of these terms
  • Attempt to interfere with, disrupt, or gain unauthorized access to the site or its underlying systems
  • Scrape, harvest, or collect data from the site by automated means without our written permission

5. Intellectual property

The site's text, design, graphics, and other content are owned by Max Money Mart or our licensors and are protected by copyright and other intellectual property laws. You may view and use the site for your own personal, non-commercial purpose of seeking a loan; you may not copy, reproduce, distribute, or create derivative works from it for any other purpose without our written permission.

6. Third-party lenders and links

If you're matched with a lender, you'll leave this site to complete your application directly with them, under their own terms, privacy policy, and loan agreement — including vehicle inspection or valuation requirements and the actual title loan contract. We don't control and aren't responsible for the content, policies, or practices of any third-party lender or website you're referred to.

7. Disclaimer of warranties

THIS SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT YOU'LL BE APPROVED FOR OR OFFERED ANY LOAN.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAX MONEY MART WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE OR ANY LOAN OR LENDER YOU'RE MATCHED WITH, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

10. Dispute resolution & arbitration

Please read this section carefully — it affects your legal rights, including your right to go to court.

Any dispute, claim, or controversy arising out of or relating to these Terms of Use, your use of this website, or your application (a "Dispute") will be resolved by binding individual arbitration rather than in court, except that either party may bring a qualifying claim in small claims court instead.

By using this site, you and Max Money Mart each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Unless you and Max Money Mart agree otherwise, arbitration may be conducted by telephone, video conference, based on written submissions, or in person in the State of Texas. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You may opt out of this arbitration agreement by sending written notice to maxmoneymart247@gmail.com within 30 days of first accepting these Terms. If you opt out, this section will not apply to you, but the rest of these Terms will remain in effect.

If any part of this arbitration agreement is found unenforceable, the remainder will still apply — except that the class action waiver above may not be severed from the arbitration requirement. If the class action waiver is found unenforceable, this entire arbitration section will be void, and the Dispute will instead be resolved in court as described above.

11. Changes to these terms

We may update these terms from time to time. The version posted on this page is always the current one. Continuing to use the site after a change means you accept the updated terms.
